These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and Noble Paul ("The Kultt", "we", "us", "our"), an individual resident of India who independently owns and operates the The Kultt platform. The Kultt is currently operated as an independent proprietorship and may later be transferred to or operated by a corporate entity, in which case users will be notified and these Terms will be updated accordingly. These Terms are governed by the laws of India, including the Information Technology Act, 2000, the Consumer Protection Act, 2019, the Indian Contract Act, 1872, and the Copyright Act, 1957.
Please read these Terms carefully before using the Platform. By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately discontinue use of the Platform.
By accessing, browsing, or using the Platform in any manner, you confirm that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
These Terms constitute a valid and binding contract under the Indian Contract Act, 1872. If you are using the Platform on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
We reserve the right to modify these Terms at any time. Material modifications will be notified as prescribed in Section 15. Continued use of the Platform after notification constitutes acceptance of the amended Terms.

We reserve the right to suspend or terminate accounts that we reasonably believe are being used fraudulently or in breach of these Terms, without prior notice where we determine such action is necessary to protect the Platform or other users.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Platform for your personal, non-commercial purposes only.

All rights not expressly granted herein are reserved by Noble Paul, licensed for use by The Kultt. Unauthorised use may constitute an offence under Sections 43 and 66 of the IT Act, 2000.
The Platform permits you to submit, post, and share content including reviews, ratings, collection titles, comments, and other materials ("User Content"). You retain ownership of your User Content.
By submitting User Content, you grant Noble Paul ("The Kultt") a worldwide, royalty-free, non-exclusive, sublicensable licence to host, store, reproduce, display, adapt, and distribute your User Content solely for the purpose of operating and improving the Platform. This licence terminates when you delete your User Content or your account, subject to our retention obligations under applicable law.
We reserve the right to remove any User Content that violates these Terms or applicable law, without notice and at our sole discretion, consistent with our obligations as an intermediary under Section 79 of the IT Act, 2000, and the IT (Intermediary Guidelines) Rules, 2021.
You agree not to engage in any of the following while using the Platform. Violations may result in immediate termination of your account and may constitute offences under applicable Indian law.
Content that is obscene, pornographic, defamatory, seditious, or violates Sections 67, 67A, or 67B of the IT Act, 2000, or the Indian Penal Code / Bharatiya Nyaya Sanhita.
Content that promotes discrimination, hostility, or violence against any individual or group based on religion, race, caste, sex, place of birth, or nationality.
Impersonating any person, entity, or The Kultt, or misrepresenting your affiliation with any person or entity.
Sending unsolicited communications, artificially inflating engagement metrics, or manipulating trending data.
Uploading, sharing, or distributing copyrighted content (films, music, books, etc.) without authorisation, in violation of the Copyright Act, 1957.
Introducing malware, viruses, or engaging in denial-of-service attacks, constituting offences under Sections 43 and 66 of the IT Act.
Collecting or harvesting personal data of other users without consent, in violation of the DPDPA, 2023.
Any content that exploits or harms minors, constituting offences under the POCSO Act, 2012, and Section 67B of the IT Act.
The Platform and all its content — including but not limited to The Kultt name, logo, design, source code, text, graphics, and the selection and arrangement thereof — are owned by Noble Paul and licensed for use by The Kultt, and are protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable Indian IP laws.
Content metadata (titles, poster images, descriptions) displayed on the Platform is sourced from licensed third-party APIs. All rights in such content vest in their respective owners. No rights in third-party content are transferred to you.
If you believe that any content on the Platform infringes your intellectual property rights, please send a written notice to our Grievance Officer (details in Section 14) containing:
We will act on valid notices expeditiously in accordance with our obligations under the IT (Intermediary Guidelines) Rules, 2021.
The Kultt displays content information obtained from third-party content providers and public APIs, which may include movie, television, anime, music, game, and video metadata.
These services are used solely to retrieve content information, artwork, trailers, release dates, ratings, and related metadata displayed within the Platform.
The Kultt does not share users' personal account information with these content providers as part of normal Platform operation. Any data exchange is limited to the information necessary to retrieve requested content and metadata.
We are not responsible for the accuracy, completeness, or reliability of content sourced from these third parties. Content metadata rights vest in their respective owners.
The Platform may contain links to third-party websites or services. These links are provided for convenience only. We have no control over, and accept no responsibility for, the content, privacy practices, or terms of any third-party website or service.
Your interactions with third-party services are governed by those parties' respective terms and privacy policies. We expressly disclaim any liability arising from your use of third-party services.
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE INDIAN LAW. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
Content displayed on the Platform, including trending data and user reviews, is provided for informational and entertainment purposes only. We make no representations as to the accuracy, completeness, or fitness for a particular purpose of such content.
Nothing in these Terms shall limit or exclude liability that cannot be excluded under mandatory provisions of applicable Indian consumer protection law, including the Consumer Protection Act, 2019.
To the maximum extent permitted by applicable Indian law, Noble Paul ("The Kultt"), along with contractors, service providers, and representatives, shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Platform.
Our aggregate liability to you for any claims arising under these Terms shall not exceed the greater of:
This limitation does not apply to liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under the Consumer Protection Act, 2019 or other mandatory Indian law.
You agree to indemnify, defend, and hold harmless Noble Paul ("The Kultt") and any contractors, service providers, and representatives from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to:
You may delete your account at any time through your account settings, which will terminate this agreement with respect to your use of the Platform (subject to our data retention obligations).
We may suspend or terminate your access to the Platform at any time, with or without notice, if we reasonably determine that you have breached these Terms, violated applicable law, or your continued use poses a risk to the Platform or other users.
Upon termination:
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
If you are a consumer within the meaning of the Consumer Protection Act, 2019, you have the right to refer disputes to the appropriate Consumer Disputes Redressal Commission at the district, state, or national level. Nothing in these Terms restricts that right.
For all other disputes, you agree to first attempt to resolve the matter informally by contacting our Grievance Officer. If informal resolution fails within 30 days, disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996, conducted by a sole arbitrator appointed by mutual agreement, with proceedings in English and seat at India. The decision of the arbitrator shall be final and binding on both parties.
Notwithstanding the arbitration clause, either party may seek interim or injunctive relief from the competent courts of India. The parties submit to the exclusive jurisdiction of the courts of India for such purposes.
In accordance with Rule 3(2) of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Consumer Protection Act, 2019, a Grievance Officer has been designated to address user complaints.
Complaints should include your registered email address, a description of the issue, and any relevant evidence. We will acknowledge receipt and endeavour to resolve complaints within the timeframes specified above.
We reserve the right to amend these Terms at any time. For material changes — those that significantly affect your rights or obligations — we will:

If you do not agree with any amendment, you must stop using the Platform and may delete your account before the amended Terms take effect. Continued use after the effective date constitutes acceptance.
